What is an Executives roles under the Heavy Vehicle National Law - Chain of Responsibility
Many executives seem to believe that they have no responsibility under the Heavy Vehicle National Law - Chain of Responsibility.
This link is a brochure from the regulator specifying the responsibilities any executive in the supply chain has.
To be compliant executives need to ensure:
1) they have policies and procedures in place to cover the CoR hazards of Speed, Fatigue, Mass and Dimensions, Load Restraint and MV Maintenance - see the brochure for details
2) They have systems in place to ensure that they meet the required compliance and ensure no breaches of the HVNL.
3) They have performed a risk assessment of all their transport activities even where their company is not the owner of transport assets.
4) They have an incident management system in place to report breaches or near misses and action appropriate responses.
5) They have provided adequate training by a nationally accredited training organisation using a approved course that meets the transport and logistics training package as stipulated at link
(here the question is where you have influence or control over who does your training and at what level - did you select an accredited course with an approved RTO or did you use an unapproved trainer using an unaccredited course that does not meet the government's guidelines)
To be compliant or to have taken all reasonable practical steps a company and its executive should have a review of their systems, processes, policy's and training by an independent approved external auditor to determine a CoR Plan and where required a GAP analysis.
